Sijin VargheseMy experience with SIBD homes, Casilda apartment at Thottabhagam near Thiruvalla. I want to share my recent experience with South Indian Builders and Developers, who are currently doing their first venture at Thottabhagam called Casilda apartments. All, who are looking to invest in property or planning to buy their dream home in and near Thiruvalla, Kerala, please be careful and think twice before purchasing this one. I am not going to write in detail because there is lots to pen. I expressed my interest in this property in September and the very next day, I received a call from the Mr. Samuel V. (MD) of SIBD homes. He gave me an introduction on the project and when I met him face to face he explained in detail as to where they are with the whole project. In brief, the below given points were covered that day stating that 1. All paper works are in order for the building 2. All permissions are received for the building 3. Completion date is March 2016 and no later than April 2016 I had expressed my interest for an apartment over the phone (which was available), but, on the day I visited them, they said that the apartment was sold which made me think about dropping the plan on buying the apartment. Hearing that Samuel suddenly stated that he will try to get the apartment secured somehow and not to drop the plan. My parents visited the office early October 2015 and they were told to secure the apartment by paying the booking amount at the earliest and if we withdraw before signing the agreement then, he will refund the whole amount. And, if the withdrawal is after signing the agreement then as per the policy they will reduce 5% before refunding. Anyways, my father secured the apartment by paying the booking amount. A few days later we received the agreement and to our surprise, all the clauses were in their favour. Most importantly, the completion date was not at all mentioned in the document. In short, the document said that the project would take 18 months to complete (bringing the completion to late 2017). On seeing that I contacted Samuel and he stated that the agreement was prepared in line with the authority norms and hence, they cannot put the completion date on it. We approached a lawyer who requested a few more details from the builders, and it came to light that there were quite a few major issues with the papers impacting the completion dates. Hence, without signing the agreement we decided to withdraw and requested for our refund by mid-October 2015. Samuel started to come up with one reason on top of the other 1. Samuel said that he will reduce 5% against the admin charges. We agreed. 2. Gave a post-dated cheque in November 2015 and asked us to wait for 3 months. We agreed. 3. In February 2016, we submitted the cheque as stated and the cheque bounced. We informed him. He started to make excuses and give us false promises, and he was pretty rude in his behaviour. 4. In the end, I had to move legally to get my money back. He was still unmoved and deposited the money after a month and before the any court hearings.
